1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Tracka platform, including the main application, platform dashboard, and Data API (collectively, the "Services") provided by Tracka ("we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Tracka provides an enterprise-grade sickle cell data and analytics platform for health organizations, facilities, and research institutions in Africa. The Services include patient registration and management, clinical data tracking across eight domains (visits, crises, labs, treatments, hydroxyurea, transfusions, vaccinations, and growth), offline-first field data collection, clinical analytics and reporting, and a Data API providing access to anonymized, aggregated sickle cell disease data.
3. User Accounts and Access
To use the Services, you must create an account with accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or use of your account.
Access to the Services is governed by role-based permissions. Four roles exist: super admin, product admin, field agent, and external monitor. Each role has precisely scoped permissions that determine which features, data, and facilities are accessible. You agree to use the Services only within the scope of your assigned role and permissions. Attempting to access data or functionality outside your authorized scope is a violation of these Terms.
4. Acceptable Use
You agree to use the Services only for lawful purposes related to sickle cell disease management, healthcare delivery, public health research, or authorized administrative functions. You specifically agree not to:
- Access or attempt to access patient data without proper authorization or consent
- Share your login credentials with unauthorized individuals
- Circumvent, disable, or interfere with security features of the Services
- Use the Data API to attempt to re-identify anonymized patients
- Exceed your authorized API rate limits or use automated tools to circumvent rate limiting
- Use the Services to store or transmit malicious code or content
- Reproduce, duplicate, copy, sell, or resell any portion of the Services without express permission
- Use patient data for marketing, advertising, or any purpose unrelated to healthcare
5. Data API Terms
If you access the Tracka Data API, the following additional terms apply:
- API access is subject to the rate limits and data granularity specified by your subscription tier (Basic, Pro, or Enterprise).
- All data provided through the API is anonymized and aggregated. You agree not to attempt to re-identify individuals from the data.
- API keys are confidential and must not be shared, published, or embedded in client-side code.
- You may use API data for research, analysis, and internal reporting. Redistribution of raw API data to third parties requires prior written consent.
- We reserve the right to revoke API access for violations of these terms or abuse of the service.
6. Patient Data and Privacy
The handling of patient data is governed by our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that patient health information is sensitive and agree to handle all patient data in accordance with applicable healthcare data protection regulations, including the Nigeria Data Protection Regulation (NDPR). You agree that patient data collected through the Services will only be used for authorized healthcare, clinical management, and public health purposes.
7. Security Obligations
You agree to maintain the security of your account by: using a strong password meeting our minimum requirements (12 or more characters with uppercase, lowercase, numbers, and special characters), enabling two-factor authentication when available (mandatory for admin roles), not sharing credentials or session tokens, logging out of shared or public devices after use, and promptly reporting any suspected security breaches to our security team at security@tracka.promatics.ng.
8. Intellectual Property
The Services, including all software, designs, text, graphics, and other content, are owned by Tracka and protected by intellectual property laws. Your use of the Services does not grant you ownership of any intellectual property rights in the Services or the content you access. Patient data remains the property of the health organizations and patients it pertains to. Anonymized, aggregated data provided through the API may be used by API consumers in accordance with their plan terms.
9. Service Availability and Support
We strive to maintain 99.9% uptime for the Services. However, we do not guarantee uninterrupted access. The Services may be temporarily unavailable due to scheduled maintenance (which we will announce in advance), emergency maintenance, or factors beyond our control. The offline-first design of the main application is specifically intended to allow continued data collection during periods of service unavailability. Support levels vary by subscription: Basic receives email support, Pro receives priority support, and Enterprise receives dedicated account management.
10. Payment Terms
Data API subscriptions are billed monthly in US dollars. Payment is due at the start of each billing period. Failure to pay may result in suspension of API access. Upgrades take effect immediately with prorated charges. Downgrades take effect at the start of the next billing cycle. We reserve the right to modify pricing with 30 days' notice to active subscribers.
11. Limitation of Liability
To the maximum extent permitted by law, Tracka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claims arising from the Services is limited to the amount you paid for the Services in the twelve months preceding the claim. The Services are a data management tool and do not provide medical advice. Clinical decisions based on data in the platform are the sole responsibility of qualified healthcare professionals.
12. Termination
You may terminate your account at any time by contacting our support team. We may suspend or terminate your access if you violate these Terms, fail to pay fees when due, or if required by law. Upon termination, your right to access the Services ceases immediately. Patient data will be handled according to our data retention policy and applicable healthcare regulations. We will provide a reasonable period for authorized data export prior to permanent data deletion.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify users by email and post the updated Terms on this page with a revised "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the Services shall be resolved through the courts of Lagos State, Nigeria, unless otherwise agreed in writing by both parties.
